Paidchain respects your privacy and is committed to handling your personal information in accordance with the Personal Data Protection Act 2020 (“Act”).

This privacy policy explains how we manage your personal information we collect about you. Please read this privacy policy before accessing and using this Website. By accessing and using this Website or registering as a Merchant and creating an account or using Paidchain’s services, you acknowledge that you have read, understood and agreed to the practices described herein and you hereby consent for Paidchain to collect, manage, and use your personal information.

Paidchain may, at its discretion, change this privacy policy from time to time but any changes will be posted at the Website, and any changes therein shall become effective on a going forward basis. You are encouraged to review the privacy policy whenever you access your Account and/or the Website to make sure that you understand how any personal information you provided will be used.

Note: The privacy practices set forth in this privacy policy are for the Website only. If you link to other websites, please review the privacy policies posted at those websites. This privacy policy does not apply to employee records.

PURPOSE OF THE PRIVACY POLICY

Paidchain takes its obligations under the Act seriously. Paidchain will take all reasonable steps to comply with the Act to safeguard and protect the privacy of the information that Paidchain holds. This privacy policy sets out how Paidchain intends to do so.

WHAT PERSONAL INFORMATION DOES Paidchain COLLECT AND HOW DOES Paidchain COLLECT IT?

The type of information that Paidchain collects and holds includes:

(I) personal information about the individuals who use Paidchain’s services such as your name, mailing address, email address, telephone number, facsimile number, date of birth, postal address, bank details and other transaction or registration details;
(II) your activities in the Account and Website;
(III) your transaction activities whereby your customers’ personal information is kept anonymous save in for the date of transaction, transaction amount, name of bank and the last four digit of the credit/debit card used; and
(IV) any other people who come into contact with Paidchain.

Paidchain may also collect data that can, under certain circumstances, indirectly lead to personal identifiable information. Merchants who render Paidchain’s services may choose to provide or store non-personal information or related data in their Account profile. You are aware, consent to and authorise Paidchain to collect, analyse, manage, process, use and/or share your personal information to any of its affiliates, agents, employees or any relevant regulatory authorities to view your personal information as well as any information you provided to Paidchain for statistical purposes or in order to improve Paidchain’s services/Website or for bona fide purposes that benefits/assists you and/or the relevant regulatory authorities.

Paidchain collects your personal information:

(I) Directly from you;
(II) When you deal with us by telephone, letter, email or any means of communication;
(III) When you access the Account;
(IV) Or from any other sources (including but not limited to credit reporting agencies such as Experian and CTOS Data Systems Sdn Bhd).

Paidchain will generally collect this information by way of your voluntary registration of the Account otherwise, Paidchain will not collect or monitor any personal information about you without your consent.

By registering and creating an Account, you have consented:

(I) For Paidchain to acquire your personal information from any other third parties including but not limited to credit reporting agencies such as CTOS Data Systems Sdn Bhd and Experian;
(II) When required by the relevant third parties, to immediately provide a written consent of the same for Paidchain to acquire your personal information thereof; and
(III) To allow such other third parties to share with Paidchain and for Paidchain to share with its affiliates (including banks) your personal information for the purpose of processing your request/application or assisting in obtaining/concluding a business solution for you or for your benefit/advantage or for any other purposes described herein.

Upon your registration of Account, Paidchain collaborates with Credit Reporting Agency(s)(CRA) to obtain and analyse your personal information and conduct credit checks for the purposes described herein. As such, please read the Terms of Use and Privacy Policy of the respective Credit Reporting Agency(s)(CRA). By creating and registering an Account with Paidchain, you acknowledge that you have understood and agreed to the respective Credit Rating Agency Terms of Use and Privacy Policy.

When you visit the Website, Paidchain may record the following information, for statistical purposes or in order to improve Paidchain’s services/Websites:

(I) The date and time of your visit;
(II) Webpages you have accessed;
(III) Documents you have downloaded;
(IV) Your IP address; and
(V) The type of operating system and internet browser you use.

Where it is lawful or practicable to do so, Paidchain will provide you with the option of remaining anonymous when dealing with Paidchain.

HOW MIGHT Paidchain USE THE PERSONAL INFORMATION?

Your personal information is confidential.

Generally, Paidchain may manage, use, process, analyse, share, store, and collect the personal information for the following purposes:

(I) To provide services and support to you;
(II) To respond to your requests, inquiries or applications;
(III) To evaluate, develop and enhance Paidchain’s services, Website and gateway;
(IV) To resolve disputes and troubleshoot problems;
(V) To enforce Paidchain’s policies;
(VI) To conduct system administrations, such as for the technical support of Paidchain’s services, website, gateway and computer systems;
(VII) To provide information to individual services that Paidchain thinks may be of interest/beneficial to you;
(VIII) To communicate special offers, promotions, market research surveys or inform you of potential businesses/opportunities/financial assistance/business solutions which may interest you; and
(IX) To provide any relevant authorities for the purpose of investigation of any suspicious/fraudulent transactional data.

Otherwise, Paidchain will not use any personal information about you without your consent.

HOW MIGHT Paidchain DISCLOSE THE INFORMATION?

You authorise and consent to Paidchain disclosing your personal information to:

(I) Populate the required fields of any legal agreements, including but not limited to Intellectual Property Licence Agreements and Non-Disclosure Agreements to which you become party by virtue of your actions while using Paidchain’s services.
(II) Enforce the policies of Paidchain.
(III) Respond to any claims that transactions which you concluded through the use of Paidchain’s services violates the rights of any other persons and/or is against the laws of Malaysia.
(IV) Protect the rights of any person.
(V) Service providers such as organisations who provide data processing, printing and fulfilment operations.
(VI) Entities for whom Paidchain is acting as an agent and Paidchain’s affiliates.
(VII) Any court, tribunal or regulatory authority as required by law, including in response to subpoenas, court orders or legal process, or to establish or exercise Paidchain’s rights to defend itself against legal claims.
(VIII) Any individual or authority whom Paidchain believes necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, safety of person or property, violation of Paidchain’s policies, or as otherwise required by law.
(IX) Anyone authorised by the individual.
(X) To another company, in the event that Paidchain, the Website or a related asset or line of business is acquired by or transferred to that other company.
(XI) Any individual or authority to protect the rights, property or personal safety of any member of the public or Paidchain.
(XII) Paidchain’s related bodies corporate.
(XIII) Paidchain’s employees, insurer, third party contractors, agents or to Paidchain’s sponsors on a confidential basis.
(XIV) Paidchain’s business partners, where from time to time, Paidchain partners with other companies to provide additional services and may share your information.
(XV) Paidchain’s service providers (including service providers that provide web maintenance, gateway maintenance services).
(XVI) Any other person or entity (“Recipient”) upon the basis that the Recipient may only collect, use or disclose the information for the purpose for which that information was originally collected by Paidchain.

Paidchain will otherwise not transfer your personal information, or use, sell or disclose your personal information without your consent, unless:

(I) Such disclosure is permitted under the Act;
(II) Paidchain is required by law to disclose that information;
(III) Paidchain is trying to protect against or prevent actual or potential fraud or unauthorised transactions; or
(IV) Paidchain is investigating fraud which Paidchain believes may have already taken place.

Whilst using the Website, the Website may contain links to other websites owned or operated by third parties. You should make your own enquiries as to the privacy policies of these third parties. Paidchain is not responsible for information on, or the privacy practices of such websites.

You consent to and authorise Paidchain to transfer your personal information to an organisation or individual outside Malaysia. Paidchain will only transfer personal information to a foreign country for the purpose of providing you with the services of Paidchain and for carrying out any request you make when you use Paidchain’s services.

Your personal information may be transferred overseas if you are accessing Paidchain’s Website from a country outside of Malaysia.

If Paidchain sells all or part of its business or makes a sale or transfer of all or part of its assets or is otherwise involved in a merger or transfer of all or part of its business, Paidchain may transfer your personal information to the party or parties involved in the transaction as part of that transaction. Paidchain will not otherwise disclose any personal information about you without your consent.

MANAGEMENT AND SECURITY OF PERSONAL INFORMATION

Paidchain takes reasonable steps to keep your personal information secured. Personal information about individuals is stored on a secured cloud server that sits behind a firewall. Employee’s access to personal information is limited.

Paidchain cannot and does not guarantee that your personal information will be protected against unauthorised access or misuse or abuse. Paidchain does not accept any liability for the improper actions of unauthorised third parties.

In relation to the Internet, while Paidchain uses reasonable efforts to safeguard the privacy of your personal information, transmissions made by means of the Internet cannot be made absolutely secure. Paidchain assumes no responsibility for disclosure of data due to errors in transmission or by unauthorised third parties. Paidchain also assumes no responsibility or liability for third parties such as advertisers or other entities who utilise banner ads and links from the Website. If you click through a banner ad or link and submit your information to an advertiser, you will be subject to the privacy policies of those third party websites.

PERSONAL INFORMATION ABOUT OTHER PEOPLE

You must not provide personal information to Paidchain about another person, unless that person has authorised Paidchain, through you, to collect, use and disclose personal information about that person for the purposes described in this privacy policy.

You agree to only use another person’s personal information, upon the person’s consent, for the purposes described in this privacy policy. Paidchain encourages you to respect the privacy of others. To best maintain the privacy of your personal information, Paidchain will only provide relevant and necessary information to its affiliates or the relevant regulatory authorities for the purposes described in this privacy policy.

WHAT HAPPENS IF YOU CHOOSE NOT TO PROVIDE THE INFORMATION?

You are not obligated to give Paidchain your personal information. However, if you choose not to provide Paidchain with your personal information, we may not be able to provide you with information about the services offered by Paidchain or to fulfil one or more other purposes of collection of your personal information.

Where possible, Paidchain will collect your personal information directly from you.

If your personal information is collected from a third party, Paidchain will take reasonable steps to inform you of the collection and provide you with our privacy policy.

USE OF COOKIES

The Website collects information through the use of “cookies”. Cookies are anonymous, unique alphanumeric identifiers sent to your browser from a website and stored on your computer’s hard drive. The information we collect via cookies does not personally identify you, although it does identify your browser. We use this information to provide you with customised information when you visit the Website, and to collect aggregated user data for the purposes of usage analysis, quality control and administering and improving the Website. Aggregated data (which cannot be used to identify you) may be shared with third parties.

Paidchain endeavours to ensure, but in no way guarantees, that the personal information it holds about you is accurate, complete and up to date. You will generally be able to update the information we hold about you by accessing your Account and profile information on the Website. You should promptly update your personal information if it changes or becomes inaccurate.

You can help keep your personal information up to date and secured by maintaining confidentiality of any password, user name, accounts and profiles used on the Website. In the event that you share your password or other personal information with others, you will be responsible for all actions taken on your account.

SENSITIVE INFORMATION

The term “sensitive information” refers to personal information about an individual’s racial or ethnic origin, political or philosophical beliefs or affiliations, trade or professional affiliations, sexual preferences or practices or criminal record and health information. We do not collect sensitive information unless it is volunteered by you.

You will generally be able to view the personal information we hold about you by accessing your Account or profile information on the Website.

Paidchain will, on your written request, provide you with access to personal information held by us about you, subject to any limitations or exceptions in the Act.

We will deal with the written requests for access within a reasonable time. You must pay us for reasonable costs incurred by us in providing you with access.

If Paidchain refuses to provide you with access to personal information about you, we will provide you with reasons for the refusal, in accordance with the requirements of the Act.

SECURITY OF YOUR PERSONAL INFORMATION

Paidchain will take all reasonable steps to protect the security of the personal information that we hold. This includes taking appropriate measures to protect electronic materials and materials stored and generated in hard copy (if any). We also take reasonable steps to destroy or permanently de-identify your personal information where it is no longer required and to protect your personal information from unauthorised access, disclosure, loss, misuse and alteration.
